Rodrigo Da Silva focuses his practice on asset recovery and financial fraud. He has represented multinational corporations, Receivers, Trustees, and other foreign office holders in matters pending in U.S. courts. Da Silva has litigated large and complex multi-jurisdictional asset recovery actions against debtors who have committed fraud or have secreted assets. Currently, Astigarraga Davis is lead co-counsel for the multi-billion dollar Stanford International Bank (SIB) liquidation out of Antigua & Barbuda which stems from the world’s second largest Ponzi scheme. Most recently, Da Silva has been actively working on the Stanford matter and is presently assisting the newly-appointed Joint Liquidators of SIB in their efforts to recover hundreds of millions of dollars worth of assets for the benefit of approximately 27,000 victims.  Recent published cases in which Da Silva has participated includes Sallah v. Worldwide Clearing, LLC, et al., 2011 WL 5914034 (S.D. Fla. Nov. 28, 2011) (order denying various motions to dismiss fraudulent transfers and unjust enrichment claims by Receiver).  Da Silva’s recent speaking engagements include AIJA’s Half-Year Conference on Bribery & Corruption, Recovery of Stolen National Wealth: Time for a New Model? (São Paulo, Brazil, November 2011).

Da Silva has also been involved in obtaining foreign main recognition under Chapter 15 of the U.S. Bankruptcy Code for Trustees of bankrupt Latin American companies and financial institutions in cases where insiders misappropriated hundreds of millions of dollars worth of assets into or through the United States. In the course of his practice, Da Silva handles complex e-discovery issues in class action litigations and has counseled clients on e-mail retention policies, litigation hold procedures and the processing, review and production of electronically stored information.  While attending Pace University School of Law, Da Silva worked as a litigation support professional and counseled clients and attorneys on the proper implementation of litigation holds and discovery strategies to meet the challenges of electronically stored information.

Da Silva approaches his practice with personal ties with Latin America. Born and raised in Uruguay, he is a native Spanish speaker and has spent considerable time in the region. Da Silva also works extensively on matters originating in Brazil and is fluent in Portuguese. He is a member of the American Society of International Law and the International Law Sections of the American Bar Association and the Florida Bar.

Da Silva is admitted to practice in Florida, New York and New Jersey, in addition to the U.S. Court of Appeals for the Second Circuit, the U.S. District Courts for the Southern and Middle Districts of Florida, the Southern and Eastern Districts of New York and the District of New Jersey.
